No matter what everyone is saying, once the administrative agency has issued its decision, it can only be overturned by the court for a clear violation of the authority granted by the enabling legislation or an abuse of discretion. For a 404 permit, it’s a clearly authorized decision to be made. So a court would have to find an abuse of discretion which is almost NEVER found. The court gives deference to the decision of the administrative agency under it’s authority to do so. If the USACE grants the permit under the ROD with or without conditions, the decision will be final, even though I am sure lawsuits will be filed.
